The will of Nathaniel Howcott, made 1770

 

Text

 

In the name of God Amen. I Nathaniel Howcott of Chowan in the Province of North Carolina being sick but of sound and Perfect mind and memory, in manner and from following do make ordain constitute and appoint this my last will and testament that is to say

 

Imprimis I Recommend my soul to almighty god that gave it me and my body to be buryide at the discretion of my Executors herein after mentioned.

 

Item. My will and desire is that all my Just debts be paid.

 

Item. I give to my loving wife Sarah Howcut half the use of my Plantation and house wherein I formerly lived during her natural life, I also give to my said wife the use of one negro woman named Febea also the use of a negro man called Frank and likewise the use of a negro man named Joe and the use of a negro man caled Brutus and a negro Girl called Dol the use of said Negroes are be no longer than my wifes natural life also a hay mans and womans saddle and bridle two cows and calfs feather Beds and Furniture large walnut table one Tea Table six black chairs one large looking Glass Three Iron Pots, on [sic] tea Kettle one pair fire Tongs and one pair Iron Dogs and all the pictures in my house one frying pan two [pates?] Tramills two axes one Kettill and Chest one Desk one case and bottles one case of knives and forks and also the chaney tea [wan?] six silver tea spoons three broad [?] one bar plow and a cart one yoke of oxen.

 

Item. I give to my Daughter Sarah Hoskins one negro woman called Vilet and her children to wit Peggy, Jack and Dick also one negro man called Jacob and one negro Girl called Dol and one feather bed and furniture one large walnut Table one large Iron Pott.

 

Item. I give to my grand son Nathaniel Howcott the half of my Plantation in Green Hall Where in I formerly lived and the other half after my wifes decease to him & his heirs for ever Except he should die before he comes to the age of twenty one years, then my will and desire is that my grandson Thos. Hoskins shall have the said Plantation and lands thereunto belonging.

 

Also I give to my said grandson Nathaniel Howcott two negroe men called Tankard Joe one negroe woman called Feabea after my wifes decease.

 

Item I give to my gran Daughter Mary Howcott one negroe man called Brutus one Negro Girl called Fillis one Negro Girl called Sook after my wifes decease.

 

Item. I Give to my two Grandsons Samuel Benbury & Richard Benbury sons of my daughter Thamer Benbury deceased all the negroes that I lent to Thomas Benbury to wit: one negroe man called davy One negroe woman called Sook and their increase to be equally divided between them when Samuel comes of age and if either of them should die before he comes of age my will and desire is that the surviving one shall have all the said negroes also I give my said grandsons Twenty Shillings a piece Proclamation money and my will and desire is that the said Samuel Benbury and Richard Benbury shall in no wise inherit no part of my Estate more than what I have already given them either real or personall also my will is that the houses and lots that I now live on to be sold at the descretion of my executors also the land that is now in dispute at Bath with all with all the residue and remaining part of my Estate which I shall not give away to be sold at the descretion of my executors to pay my debts and the money arising more than paying debts to be equally divided between my wife my daughter Sarah Hoskins and my two grand-children Nathaniel Howcott and Mary.

 

Item. I give to my daughter in law Sarah Howcott One negroe Girl called Hannah.

 

Item. I nominate constitute & appoint my son in Law William Hoskins & Thomas Hoskins executors to this my last will and testament and do hereby revoke disannul and make void all former will or wills by me heretofore made and desire they may see the same duly executed.

 

In witness whereof I the said Nathaniel Howcott to this my last will and testament have set my hand and seal this eighteenth day of September in the year of our Lord One thousand seven hundred and seventy.
